Gujarat High Court States That Young People Are Facing Difficulties to Choose Their Life Partner Due to Caste System.

The Bench consisting of Justice Sonia Gokani and NV Anjaria noted while extending police protection to a couple who married against the will of girls parents that the “Caste system in the country is making it more and more difficult for the young people to decide their own life partner and the rigidity in the minds of adults in the family becomes the serious cause of the division of human relationship.”
The court further added that this also makes it difficult for the administration to handle the social and emotional upheaval that comes along with it and finally culminates into a legal battleground.
In the above case, the couple got married in January 2020 against the will of girls’ parents and took police protection for the month of February. The petitioner moved the high court under Article 226 of the Constitution of India as the girl’s parent tried to separate the petitioner for his wife when they visited Rajasthan.
The petitioner’s wife was produced before the court on 9 June via video conferencing and was physically produced at the District Court of the Palanpur. The additional District Court judge was also present to assist the case. The petitioner’s wife expressed her desire to join her husband and mentioned that she is carrying their child.
The High Court directed the police to escort the petitioner’s wife to her matrimonial home, and that the police protection is given to them to be continued for another 4 months. It further requested the additional judge to direct the families to find a solution to this problem and go for mediation if possible.
