Advocates urge that Chief Justice of the Allahabad High Court to order a Judicial Inquiry of the Vikas Dubey Encounter

On the morning of July 10, 2020, Vikas Dubey who was main accused of killing eight cops on July 2, 2020, in Kanpur, was shot dead by Kanpur Police in an encounter. He was charged over 60 cases. While bringing back him to Kanpur he was encountered by the police when he tried to escape from the custody of Police. A night before the encounter of Vikas Dubey, a petition was filed by Advocate Ghanshyam in Supreme Court seeking protection for him.

The gangster was arrested at the Mahakal Temple in Ujjain, Madhya Pradesh. A few hours ago, two of his accomplices were also killed in separate encounters. The petition for security filed by Advocate Ghanshyam also includes a plea to probe by CBI in the matter of killing the five aides of Vikas Dubey in the past one week and also to register an FIR on the demolition of Vikas Dubey’s house in Kanpur.

The Kanpur Police said in a statement that while bringing him back to Kanpur, the car overturned and the policeman and the accused i.e. Vikas Dubey was injured. The accused tried to take advantage of the situation to escape. He grabbed a Gun of the Policeman and ran. The Police Team tried to get him back, they surrounded the accused to make him surrender. The accused refused to surrender and started firing on Police. The police fire back in self-defense.

The Advocates has urged that the Chief Justice of Allahabad High Court order a judicial Inquiry of the Vikas Dubey’s Encounter. A letter has been written to the Chief Justice of Allahabad High Court by Advocate Bhavya and Advocate Devesh Saxena in which they urged to High Court to take cognizance of the Extra-Judicial Killing of the Gangster Vikas Dubey. They were appalled by the Sorry state of the affairs in the state of UP.

The Advocates claimed that the encounter story narrated by the UP police is fictional and was inspired by the scripts of films. They said in their appeal that it is highly unlikely that a criminal who was in the custody of numerous SIT officials tried to escape when he was in tightly classified security of the police officials.

They also urged that according to the statement of police the car was overturned but as per the live coverage of various news channels, the road through which the police was bringing back Vikas Dubey to Kanpur was in perfectly good condition than how could the car be overturned without any external force by the third party. The entire place of incident was a highway, then why would a sane person try to escape from such tight security when he had no place to hide on the highway.

It is the right of every person to get a chance of fair trial especially in criminal offenses the registration of FIR and inquiry by the magistrate is mandatory under the code of criminal procedure.

The Advocates urged that if this type of incident continued to happen then it would become an unwanted societal norm. It is an act of valor by police officials.

Many more petitions are being filed demanding CBI inquiry of Vikas Dubey’s encounter. Because incidents like these are a threat to the Judicial System. The common man will lose faith in the Judicial System.
